As it appears that defendants Boston Gas Company and Boston Edison Co. did not receive the attached notice scheduling a status conference on February 8, 1994, it is hereby ORDERED that:

1. Counsel for all parties shall discuss settlement and all other outstanding issues. Counsel shall by March 11, 1994 report the results of their discussions. If a settlement is not reached, their report shall describe the outstanding issues and succinctly state the parties' respective positions concerning them.

2. If necessary, a settlement conference will be held at 3:00 p.m. on April 14, 1994; counsel and representatives of all parties with full settlement authority shall attend.

Pursuant to Fed. R. Civ. P. 41(a)(1)(ii), the parties in the above-captioned action hereby stipulate that all claims against the defendant Massachusetts Department of Public Utilities be dismissed with prejudice, with each party to bear its own costs, and with all rights of appeal waived.
